Proposition 40 Document
PLease scan this document that covers the grant money which came from Propostion 40.
You will see 2 highlighted areas that cause concern. One is a section that says "acquistion" means they were in the process of getting a title - we had not even been notified of the District's intent of the project at the time of the application.
The second highlighted section discusses the need to have a "willing" seller if you plan to use grant money to purchase land.

Engineering Info
This letter was provided by the District Engineer. It was not given to us until after the 13 Dec 06 meeting. It does provide useful information, however the whole project is being re-designed.

Grant Application
This file is the application that the ACSD used to acquire the $1.1M grant from the State of California. It was submitted well before we were notified of their intent to acquire our farm.

Google Earth View
This attached picture shows our farm (rectangular farm in center of the photo with a canal cutting through the northern portion). You can also view this photo on the "View our Farm" button to the left.
You can see the existing well (round silver tank) just to the west of our property. The property the well is on is not in the Williamson Act. The property to the north of the well and south of the canal is in the process of non-renewal (being withdrawn from the Williamson Act). The empty lots directly adjacent to the east of the property are not in the Williamson Act.
All the property north of the canal in this photo is in the Williamson Act.

Environmental Checklist part 1 (Initial)
Please read pages 6 & 12 first.
Page 6 is clearly marked that our property is not in the Willimason Act - a direct lie!
Page 12(c)says there is no school within a quarter of a mile - the ACSD well next to our house is on school property!
Notice there is no mention of smell, mosiquitos, concetrated aresnic levels, or how they plan to mitigate any of these issues.

Proof of Williamson Act
This file is a copy of the assessor's parcel map showing our property is in the Williamson Act and that there is more land around us that is not in the Williamson Act.

Letter to Conservation Department
Please read what the District sent to the Department of Conservation this month in order to get them to in effect "pull our land out" of the Williamson Act.
In essence, this is an attempt to break the government's part of the contractual agreement that the Davidson's have upheld for 30 years.
Specifically note how the District claims there is no other land available (para iii & x). Look at the attached Google Earth map provided on this page and make your own determination.

Department of Conservation Reply
This is the orginal reply the Department of Conservation sent to the ACSD.
It spells out clearly the lack of proof the ACSD provided in order to exercise eminent domain against Williamson Act land.
